The terms governing your use of the DocLinQ platform

These Terms & Conditions ("Terms") govern your access to and use of the DocLinQ platform, including our websites, mobile applications, and related services (collectively, the "DocLinQ Platform"). Please read these Terms carefully before using our services.
By accessing or using the DocLinQ Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services. These Terms apply to all users, including patients, providers, practice staff, and administrators.
1. Acceptance of Terms
By creating an account or using any portion of the DocLinQ Platform, you confirm that:
- You are at least 18 years of age, or are using the platform under the supervision of a parent or guardian.
- You have the legal authority to enter into these Terms.
- You will comply with all applicable federal, state, and local laws and regulations.
- You have read and understood our Privacy Policy, which is incorporated into these Terms by reference.
2. Description of Services
DocLinQ provides a healthcare communication and care management platform that enables:
- Secure messaging and communication between patients and their care teams.
- Care plan management, including goal tracking and health monitoring.
- Appointment scheduling and reminders.
- Integration with Electronic Health Record (EHR) systems.
- AI-assisted health insights and risk analysis (informational purposes only — not a substitute for professional medical advice).
- Practice management tools for healthcare providers and staff.
3. User Accounts
A. Account Registration
- You must provide accurate, complete, and current information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must notify us immediately of any unauthorized access to your account.
- Each user may maintain only one active account unless otherwise authorized.
B. Account Responsibilities
- You are solely responsible for all activities that occur under your account.
- You must keep your account information up to date.
- You may not transfer your account to another person without prior written consent from DocLinQ.
- DocLinQ reserves the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to use the DocLinQ Platform to:
- Violate any applicable laws, regulations, or third-party rights.
- Transmit any harmful, offensive, or unauthorized content.
- Attempt to gain unauthorized access to any part of the platform or its related systems.
- Interfere with or disrupt the integrity or performance of the platform.
- Harvest or collect personal data of other users without their explicit consent.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Use automated tools, bots, or scrapers to access or extract data from the platform.
- Upload or distribute malware, viruses, or any other malicious code.
5. Medical Disclaimer
The DocLinQ Platform is a communication and care coordination tool. It is not a medical device and does not provide medical diagnoses or treatment recommendations.
- All AI-generated insights (including risk scores, food analysis, lab analysis, and care recommendations) are for informational purposes only and do not constitute medical advice.
- Always consult a qualified healthcare professional for medical decisions.
- In case of a medical emergency, call 911 or go to your nearest emergency room immediately.
- DocLinQ is not liable for any health decisions made based on information provided through the platform.
6. Privacy and Data
Your use of the DocLinQ Platform is subject to our Privacy Policy. By using our services, you acknowledge and agree that:
- We collect and process your data as described in the Privacy Policy.
- You grant DocLinQ a limited license to use your data solely to provide and improve the platform.
- Health data accessed through Android Health Connect or Apple HealthKit is used only to display your personal activity metrics within the app and is never sold or shared with third parties.
- You retain ownership of your personal data. DocLinQ does not sell your personal information.
7. Intellectual Property
A. DocLinQ Content
All content, features, and functionality on the DocLinQ Platform — including but not limited to software, design, text, graphics, logos, and data — are the exclusive property of DocLinQ and its licensors, protected under applicable intellectual property laws.
B. User Content
- You retain ownership of any content you submit to the platform.
- By submitting content, you grant DocLinQ a non-exclusive, royalty-free license to use, store, and process that content solely for the purpose of providing the services.
- You are solely responsible for ensuring you have the rights to any content you submit.
8. Third-Party Services
The DocLinQ Platform may integrate with or link to third-party services, including but not limited to:
- Electronic Health Record (EHR) systems (e.g., NextGen, Athena)
- Payment processors
- Communication providers (SMS, email, push notifications)
- Cloud infrastructure and hosting providers
- AI and analytics services
Your use of any third-party service is governed by that service's own terms and privacy policy. DocLinQ is not responsible for the content, practices, or policies of third-party services.
9. SMS & Email Communications
- By providing your phone number or email address, you consent to receive service-related communications from DocLinQ.
- We will only send marketing or promotional messages with your explicit consent.
- You may opt out of SMS messages at any time by replying "STOP" to any message.
- You may unsubscribe from marketing emails using the "Unsubscribe" link in any email.
- Opting out of communications will not affect your ability to use the platform but may limit certain notifications.
10. Disclaimers and Limitation of Liability
A. Disclaimers
THE DOCLINQ PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
B. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DOCLINQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.
DocLinQ's total liability to you for any claim arising out of these Terms shall not exceed the amount you paid to DocLinQ in the twelve (12) months preceding the claim, or $100, whichever is greater.
11. Indemnification
You agree to indemnify, defend, and hold harmless DocLinQ, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the platform, your violation of these Terms, or your violation of any third-party rights.
12. Termination
- DocLinQ reserves the right to suspend or terminate your access to the platform at any time, with or without cause, and with or without notice.
- You may terminate your account at any time by contacting our support team.
- Upon termination, your right to use the platform will immediately cease. Provisions of these Terms that by their nature should survive termination will continue to apply.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles.
- Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Howard County, Maryland.
- Before initiating formal proceedings, the parties agree to attempt to resolve disputes informally by contacting DocLinQ support.
14. Changes to These Terms
DocLinQ reserves the right to modify these Terms at any time. We will notify you of significant changes through the platform or via email. Your continued use of the DocLinQ Platform after changes take effect constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
